2017년 뉴욕타임스를 명예훼손으로 고소한 전 알래스카주지사 사라 페일린이 코로나19 확진으로 재판이 지연됐다. 트럼프 지지자 페일린은 백신을 접종하지 않았다. 

뉴욕타임스는 그해 6월 사설 '미국의 치명적인 정치(America’s Lethal Politics)'에서 스티브 스캘리즈 하원의원(공화당) 총격사건은 현 미국 정치 및 정책 환경의 산물이라고 주장했다. 

사설은 공화당 정치행동위원회가 2011년 개비기퍼스 하원의원(민주당)이 총격받기 전 조준해야할 민주당 의원들을 나타내는 지도를 배포한 것과 관련, 페일린을 비난했었다. 이후 NYT는 사설을 수정하면서 "정치적 수사학과 2011년 총격의 연관성이 부정확하게 언급됐다"고 정정한 바 있다.

이 소송은 2017년 맨해튼 연방판사에 의해 '실제 악의(actual malice)'를 나타내지 못해 기각됐다가 항소법원에서 번복됐다. 전문가들은 수정헌법 제 1조에 의거한 미 언론의 정치적 표현의 자유가 심판대에 오를 것으로 귀추에 주목하고 있다.  이 소송은 1964년 '실제 악의'를 입증해야 한다고 판결한 '뉴욕타임스 대 설리번'의 판례를 시험할 것으로 예상된다.

An editorial on Thursday about the shooting of Representative Steve Scalise incorrectly stated that a link existed between political rhetoric and the 2011 shooting of Representative Gabby Giffords. In fact, no such link was established. The editorial also incorrectly described a map distributed by a political action committee before that shooting. It depicted electoral districts, not individual Democratic lawmakers, beneath stylized cross hairs.

The trial comes at a time when those who argue that news outlets should pay a steeper price for getting something wrong are more emboldened than they’ve been in decades.
